In some circumstances where a party is considering litigation it may be appropriate to issue a Letter Before Action (rather than, for example a position statement).
As of 1 October 2024, the Civil Procedure Rules in the UK will oblige parties to engage in alternative dispute resolution before commencing litigation and to comply with the Pre-Action Protocols (contained in the Civil Procedure Rules). Importantly, if parties do not follow the Pre-Action Protocols within the Civil Procedure Rules the court may impose cost sanctions.
A letter before action encourages the parties to engage in open communication (a form alternative dispute resolution) and sets out clear timetables, the nature of the claim, grounds of the claim, and the remedies sought such as damages
A letter before action which is drafted in strict compliance with the Civil Procedure Rules should show that the parties have exchanged sufficient information to:-
(a) understand each other’s position;
(b) make decisions about how to proceed;
(c) try to settle the issues without proceedings;
(d) consider a form of Alternative Dispute Resolution (ADR) to assist with settlement;
(e) support the efficient management of those proceedings; and
(f) reduce the costs of resolving the dispute.
Given the new UK Civil Procedure rules and recent case of Churchill v Merthyr Tydfil Borough Council [2023] EWCA Civ 1416 the court can order the parties to engage in alternative forms of dispute resolution such as letters before action, mediation and open correspondence, and may stay proceedings.
A Letter before action can be seen to promote open communications between the parties, a quicker and less costly resolution to the dispute and more importantly construction projects to progress unhindered sooner.
OGP Consulting Limited can advise on, and draft letters before action, and also provide guidance in circumstances whereby it is appropriate to issue a counterclaim or defence in response to receiving a letter before action.
In response to demands from our clients, we are pleased to offer a fixed fee service ensuring that any letter of action, response or counterclaim is in accordance with the Protocols with the overarching aim to resolve the matter before it reaches litigation.
